I had read it a while ago, but didn't recall the details as I thought

Sure, we can split hairs.  The GPL is an open source license, but not
all open source licenses are GPL compatible.  I think it's fairly
clear to make a distinction between open source and free software.

>From Mitchell Baker's post, it looks like you can do almost anything
you want with Mozilla code -- provided that you feed changes to
the Mozilla code back to the Mozilla project.  So ActiveState is free
to release a propietary program based on Mozilla code.
